API Policy

In relation to any agreement between DIGI-Steel B.V. or any of its group companies or affiliates ("we", "us" or "our") and any customer ("you" or "your"), whether relating to the use of the DIGI-STEEL proprietary software ("DIGI-STEEL") or the supply or provision of any other software or services by us (an "Agreement"), we may offer some data in machine readable format via an Application Programming Interface ("API"). This service is offered to you subject to your acceptance of the terms and conditions contained herein as well as any other legal documents referenced in any Agreement.

Revisions
We may revise any provisions of this document in accordance with the DIGI-STEEL Additional Terms and Conditions governing the Agreement (as revised from time to time).

Scope
All of the content, documentation, code and related materials made available to you through the API is subject to these terms. Access to or use of the API or its content constitutes acceptance of these terms.

Use
You may use, for internal purposes, any DIGI-STEEL API to develop a service, to search, display, analyze, retrieve, view or otherwise 'get' information from DIGI-STEEL.

Modification or False Representation
You may not modify or falsely represent content accessed through the API and still claim the source is DIGI-STEEL.

API Limits
Your use of the API may be subject to certain limitations on access, calls, or use as set within this API policy or any Agreement or otherwise provided by us. If we believe that you have attempted to exceed or circumvent these limits, your ability to use the API may be temporarily or permanently blocked. We may monitor your use of the API to improve the service or to monitor if you are compliant with this agreement.

Disclaimer of Warranties
DIGI-STEEL makes no warranty that the API will be error free or that access thereto will be continuous or uninterrupted.

Limitations on liability
Our liability shall be subject to the exclusions and limitations set out in the NLdigital Terms governing the Agreement.

General Representations
By using the API

• you warrant that your use of the API will be in strict accordance with the Agreement, the DIGI-STEEL Additional terms and Conditions, the NLDigital Terms and all applicable laws and regulations;
• you represent that your use of the API will not infringe or misappropriate the intellectual property rights of any third party.

Indemnification
Without prejudice to any indemnities set out in the Agreement, the DIGI-STEEL Additional terms and Conditions or the NLDigital Terms, you agree to indemnify us and hold us harmless from and against any and all loss, liability, damage or expense (including, without limitation, all professional, legal and other costs) that we may suffer or incur as a result of any third party taking any action against us howsoever related to your use of the API, except where such action arises from gross negligence or wilful misconduct of our executive officials. For the purposes of the indemnification arrangements in the preceding sentence, "we" and "us" shall mean both DIGI-Steel B.V. and each and any of its group companies, affiliates, directors, officers, employees and represent­a­tives.
